  11.   The application for stay of execution of sentence of
  12. death presented to Justice Blackmun and by him
  13. referred to the Court is denied.
  14.   Justice Ginsburg, concurring.
  15.   I concur in the Court's denial of a stay of execution. 
  16. I do so based upon the conclusions of the Court of
  17. Appeals for the Eighth Circuit, reached after careful
  18. review of Guinan's very recent submissions.  As described
  19. by the Eighth Circuit panel, those submissions, presented
  20. eleven years after Guinan's trial, consist of statements
  21. -inconsistent with previous sworn testimony of the same
  22. witness, in some cases inconsistent with each other,
  23. inconsistent with the great bulk of evidence adduced at
  24. Guinan's trial, . . . on occasion inconsistent with defenses
  25. Guinan previously has asserted, . . . [and in some cases]
  26. not new at all.-  Guinan v. Delo, No. 93-3394 (CA8, Oct.
  27. 4, 1993), p. 3.
  28.   Justice Blackmun would grant the application for stay
  29. of execution.
